A Quick Guide to Bike Helmet Laws in Australia

If you're new to riding a bike in Australia or just prefer to ride without a helmet, you should at least be aware of the risks you're taking. Let's begin by stating that it is a legal requirement for you to wear an approved helmet, fastened securely, when riding a bicycle in Australia. Aside from missing out on the safety benefits of these devices, you stand to cop a significant fine if the Police see you riding without one.

What Are the Rules?

Since the early 1990s, Australia has had mandatory helmet laws for all cyclists. This applies regardless of your age or where you are riding: on the road, in a bike lane, on shared paths, or even in car parks.

The most important rule is that your helmet must be an approved model. To be legal, it must meet the Australian/New Zealand safety standard (AS/NZS 2063). When shopping for your next lid, always look for the sticker or mark that shows it’s accredited (any reputable bike retailer in Australia will follow this rule - but be sure to double check if you're buying something cheap from a marketplace or offshore). It also needs to be securely fitted and fastened while you're in motion.

Fines Across Australia

If you’re caught riding without a helmet (or with it unfastened), police can issue a fine. These amounts vary depending on which state or territory you’re in:

  • New South Wales (NSW) $319+
  • Victoria (VIC) $231+
  • Queensland (QLD) $166
  • South Australia (SA) $98
  • Western Australia (WA) $50
  • Northern Territory (NT) $25

Note: In the NT, riders over 17 are exempt on some paths, but helmets are still mandatory for all riders on roads.

Can You Lose Demerit Points from your Drivers License?

This is a big point of confusion for many riders. In most parts of Australia, you do not lose demerit points on your driver’s license for a bicycle helmet offence.

However, New South Wales is the exception. In NSW, "riding without a helmet" is an offence that can attract demerit points, and these points can even double during holiday periods. In all other states, while the fine might hurt your wallet, your license remains untouched.
